DEPUTY UNITED STATES MARSHAL INDICTED FOR EXCEEDING AUTHORIZED COMPUTER ACCESS
(HOUSTON) - A Deputy United States Marshal has been indicted for exceeding authorized access to and obtaining information from agency computers for private financial gain, United States Attorney Don DeGabrielle and Department of Justice Office of Inspector General Special Agent in Charge Wayne D. Beaman announced today.
Jose Magallan, 52, of McAllen, a Deputy United States Marshal stationed in McAllen, TX, stands accused of two counts of exceeding his authorized access to and providing information from the computers of the United States Marshal Service for private financial gain during time periods in November 2006 and in late January 2007. The indictment, returned under seal by a Houston grand jury on April 18, 2007, was unsealed today following Magallan’s appearance before United States Magistrate Judge John W. Black in Brownsville, TX. Magallan, who was arrested late Wednesday, April 25, 2007, in the McAllen area, has been in federal custody and will remain in custody pending a detention hearing to be held in Houston, TX on a date to be set by the court.
Each count of the indictment carries a maximum punishment of five years imprisonment and a $250,000 fine upon conviction.
The prosecution is the result of an investigation conducted special agents of the DOJ Office of Inspector General.
An indictment is a formal accusation of criminal conduct, not evidence. A defendant is presumed innocent unless and until convicted through due process of law.
